Kohli's plot thickens with sex racket revelations

RANCHI: Ranjeet Kumar Kohli alias Rakilbul Hussain's connections with the high and mighty, including bureaucrats, politicians and judicial officers, have put some big names under the scanner of the investigating officers in the Tara Shahdeo case.

Kohli confessed to have been running a sex racket using young girls whom he lured on the pretext of arranging admission to premier educational institutes, the police said. "He used to supply girls to bureaucrats, politicians and judicial officials. Room-307 in a Ranchi hotel and two flats in a building were booked permanently to provide services to the high profile customers," a police officer said.

Earlier, the Jharkhand High Court had suspended its vigilance registrar Mustaq Ahmad after Tara alleged that he organised her nikah with Kohli alias Hussain after their marriage was solemnised as per the Hindu rituals.

On Sunday, Namdhari admitted at a press conference that he had sought Kohli's help in some legal matters. "When the Chatra-based family of a BJP leader, who was convicted in a murder case and got life imprisonment, approached me to help him get interim bail…, I entrusted the responsibility to Kohli, whom I was introduced to, a year ago," Namdhari said.

Sources in the CID said that information gathered so far shows that Kohli had links with judicial officers and several influential persons in the administration. "The officials of IB, CID, Special Branch and district police interrogated him at the Jagannathpur police station. Kohli mentioned the names of 24 police officers at DSP rank," a source said. "Most of the DSP rank officers were newly recruited while some of them are considered close to Hussain. The judicial officers include district and sessions judge," the source said.

The Ranchi Police has claimed to gather evidence that a Bihar session judge helped Kohli escape to Delhi after Tara filed an FIR against him on August 22.

Meanwhile, the police on Sunday seized as many as 36 mobile SIM cards and 15 handsets after it carried out a raid at Kohli's house in Blair Apartments. Police had earlier sealed the apartment along with two other houses of Kohli. The recovery also included one vehicle beacon used by VIPs, two CPUs, four printers, one projector and at least 50 empty cases of mobile handsets. A CD of their marriage too was recovered from the apartment.

Kashmir a flashpoint for another India-Pak war, Nawaz Sharif says PTI | Dec 4, 2013, 01.15 PM IST


ISLAMABAD: Kashmir is a flashpoint that can trigger a fourth war between Pakistan and India anytime, Prime Minister Nawaz Sharif has said, seeking an early settlement of the issue.

He also said he had a dream of seeing Indian Kashmir free and hoped to see it happen during his lifetime.

"Kashmir is a flashpoint and can trigger a fourth war between the two nuclear powers at anytime," he was quoted as saying by the Dawn daily in his brief address to the budget session of the 'Azad Jammu and Kashmir (AJK) Council' in Pak-occupied Kashmir yesterday.

The press release issued by his office last night did not carry the above statement.

The statement had however quoted Sharif as saying that the Kashmir issue should be settled according to the aspirations of the people and the UN resolutions as peace in the region was not possible without it.

"The Prime Minister said that he had a dream of seeing held-Kashmir free from the Indian occupation and desired that this dream could turn into reality during his lifetime," the statement said.

About Indo-Pak relations, the Prime Minister categorically reiterated that it was India which indulged in the arms race, it said.

"We were drawn into arms race by India," he said. "If we had a choice, we could have diverted these expenditures to the social sector uplift and eradication of poverty," he emphasised.

Sharif also expressed his satisfaction over the improvement of situation on the Line of Control (LoC).

Bowing to pressure, govt reworks communal violence bill

NEW DELHI: The government on Thursday agreed to rework the Prevention of Communal Violence Bill, bowing to criticism from the BJP and regional parties.

BJP had attacked the original draft of the bill, promised by the UPA in 2004, saying it was loaded against the majority community and marked an assault on the powers of states. Besides, regional parties also opposed the first draft of the legislation because of their fear that it represented an intrusion into the turf reserved for states under the Constitution, rendering the prospect of its passage extremely uncertain.

The new draft bill uses a community-neutral definition to identify a group which may fall victim to communal violence, while leaving the prevention and control of communal violence essentially to state governments.

Unlike the original draft, the fresh one does way with the definition of a "group" hit by communal violence as a religious or linguistic "minority": a feature which was slammed by the BJP for its "anti-majority community" tilt. Now, communal attacks against all those "having a particular religious and linguistic identity" will be regarded as an offence.

According to the draft bill, any individual who, "either working singly or being part of an association or acting under influence of an association, engages in continuing unlawful activity of a widespread of systemic nature against a group having a particular religious or linguistic identity, by indulging in violence, intimidation or sexual assault", will be accused of the offence of organized communal violence.

The offences proposed to be covered under the law include hate propaganda, funding of communal violence, torture and dereliction of duty by a public servant.

Bureaucrats and public servants will be held accountable for acts of omission as well as commission in the build-up to as well as during riots. They will face FIRs for failing to prevent and control riots, or if they are found colluding with the rioters. Penalty will also follow if officials intentionally inflict pain or suffering on those having a particular religious or linguistic identity, under directions of a public servant.

Senior officials may also face command responsibility if they fail to exercise control over their subordinates, and the latter go ahead and aid communal violence or fail to supervise forces properly.

The draft bill proposes to punish organized communal violence with life imprisonment; hate propaganda with up to three years' imprisonment or fine or both; funding of communal violence with three years or fine or both; dereliction of duty with imprisonment ranging from two years to five years; and breach of command with imprisonment of up to 10 years.

The bill seeks to provide compensation of Rs 7 lakh to the next of kin of those killed in communal violence, Rs 5 lakh for rape, Rs 3 lakh to 5 lakh for disability, and Rs 2 lakh for grievous injury.

Significantly, changes were announced on Thursday just after the contents of a letter written by Gujarat CM Narendra Modi to the PM found its way into the media and after SP and BSP expressed fears about encroachment on the jurisdiction of states. On Tuesday, governments of West Bengal (Trinamool Congress), Tamil Nadu (AIADMK) and Odisha ( Biju Janata Dal) had expressed similar fears at a meeting convened by the Centre.

Under the re-worked legislation, the Centre's role will be limited to that of a coordinator and facilitator. The provision seeking to create a national authority to monitor action taken by the state governments to prevent and control riots has been dropped. The power to take action for controlling riots will continue to vest with the state governments.

Unlike the earlier version of the bill which sought to empower the Centre to send forces to a communally disturbed area on its own, New Delhi cannot dispatch central forces and other resources to the site of communal violence until requested by the state government.

The district magistrate and SP will be the competent authority to notify an area as communal disturbed for 60 days, with the provision that it can be expanded .

"The reworked draft bill ensures that the Centre does not override the state's powers, dispelling the so-called anti-federal concerns raised by BJP as well as parties like AIADMK, Trinamool Congress and BJD," a senior home ministry official told TOI.

Home minister Sushilkumar Shinde announced that the government plans to bring the bill during the current session of Parliament. However, meeting the deadline is going to be a tough order considering that the winter session ends on December 20, and that the government has to wrap up consultations for the draft to be finetuned by the law ministry. Even if government manages to introduce it, it will be only for making a statement for redeeming a promise that it made nine years ago. For, the bill will be referred to the standing committee of Parliament.

Narendra Modi writes to PM opposing communal violence bill


GANDHINAGAR: BJP's prime ministerial candidate and Gujarat chief minister Narendra Modi has shot off a letter to Prime Minister Manmohan Singh opposing the proposed Prevention of Communal Violence (Access to Justice and Reparations) Bill, 2013.

"The bill is ill conceived and poorly drafted. It is an attempt to encroach upon the authority of the state governments," Modi has written. He has reiterated that there is a need for wider consultation among various stakeholders.

Modi has questioned the Centre's hurry in introducing the bill in Parliament, saying that such an attempt before the Lok Sabha polls is suspicious and is driven by vote bank politics rather than genuine concern for preventing communal violence.

Stating the shortcomings in the proposed bill, Modi has written that the section defining "hostile environment" is wide ranging, vague and open to misuse. Likewise, the definition of communal violence will raise questions on whether the Centre is introducing the concept of "thought crime" in the context of the Indian criminal jurisprudence. Modi adds in his letter that these provisions have also not been examined from the view of the Evidence Act.

Strongly opposing the move to make public servants, police and security agencies criminally liable, Modi has warned that such a move can adversely impact the morale of law and order enforcement agencies besides making them vulnerable to political victimisation.

Modi has expressed concern that the proposed legislation will further divide society on religious and linguistic lines. "These identities would become more reinforced and even ordinary incidents of violence would be given a communal colour, thus giving the opposite result of what the bill intends to achieve," the letter says.
